Educating Consumers on the Potential Pitfalls of Dual Agency

Dual agency is when a single real estate agent represents both the buyer and seller in the same transaction. It’s most beneficial for sellers and buyers when separate agents represent them each in the same transaction because it prevents conflicts of interest that can arise when a single agent negotiates for both the buyer and the seller.

Agents have a fiduciary responsibility to their clients, and it’s nearly impossible for the same agent to meet the financial needs of both the seller and buyer in a single transaction. 

Imagine if the same lawyer was representing the defendant and the plaintiff in a lawsuit. It would be impossible for a single attorney to serve both sides fairly and without a conflict of interest. 

Unfortunately, although a few states have passed laws limiting dual agency in real estate, the practice remains pervasive. That’s why Zillow is working to advocate for new policies in states like New York that would limit this practice. The bottom line: You deserve an agent who works for you — and only you.
